Criminal Defense for DUIs in South Carolina

cd-head-bottom

In terms of common criminal offenses in South Carolina, DUIs top the list, especially regarding mindful drivers with clean driving records and no criminal history. Unfortunately for these drivers, a DUI conviction in South Carolina stays on your record and cannot be expunged. Even first-time offenses with a blood alcohol concentration (BAC) of 0.08 percent can be costly. Your insurance premiums go up for years, you may end up paying almost $1,000 in fines and fees, and there's a good chance you'll have to perform community service or serve jail time.

If your breathalyzer test result is more than .15%, you refuse the breathalyzer, or it is recorded as a refusal, your license will be automatically suspended, which complicates matters further. Throw in the possibility of interlock device rental, and your life may never be the same. For those reasons alone, it is crucial to approach such charges with the help of a DUI defense lawyer. At Theos Law Firm, our attorneys have years of experience in successfully fighting these types of charges.

Fortunately, if you or a loved one has been charged with DUI, there is hope. That's especially true if the accused has undergone a breath or blood test for DUI. In fact, cases that involve such tests are successfully beaten every day. At Theos Law Firm, we will thoroughly investigate your DUI case in Pawley's Island and explore every possible angle to have it dismissed.

To begin that process, your criminal defense lawyer in Pawley's Island, SC, may seek answers to many questions, including:

  • Was your DUI stop legal? If not, your case could be thrown out.
  • Is there enough probable cause or evidence for an arrest? If there is not, it's possible to file a pre-trial motion for your case to be dismissed.
  • Did officers explain implied consent rights? One of the most common errors police make is failing to take this step.
  • Did the police maintain your BAC and breathalyzer results? Breath testing often comes with inherent weaknesses. This can create doubt in a juror's mind.

Can I be Arrested for Drug Paraphernalia in South Carolina?

The simple answer to this question is a resounding "Yes." Drug paraphernalia can refer to various items such as pipes, bongs, syringes, scales, grinders, and rolling papers which are linked to drug usage, preparation, storage, or hiding. Even though some of these items may have legitimate uses, like tobacco pipes or medical syringes, they can still be scrutinized by law enforcement if there is proof of illegal drug use or intent.

Criminal Defense for Assault and Battery Cases in South Carolina

cd-head-bottom

If you are facing assault and battery charges, it is possible that you haven't actually physically harmed someone. Many people associate assault and battery with brutal beatings, but that is just one example. There are other situations that are less severe than what people typically imagine.

Car Accident Attorney Pawley's Island, SC

It's a common misunderstanding that physical injury is required for assault and battery charges. The fines, penalties, and jail time you may face depend on the severity of your charges and the number of offenses. Regardless of the degree of your charges, Assault and Battery is a serious offense that should not be taken lightly. The consequences of a conviction can be life-changing, and as such, your criminal defense lawyer in Pawley's Island, SC, should work relentlessly to fight the charges being levied against you.

Though this list isn't comprehensive, here are some of the biggest factors that dictate the severity of your assault and battery charges:

  • Age of Victim
  • Severity of Injuries Sustained
  • Size and Weight of Accused vs. Size and Weight of Victim
  • Whether or Not the Victim Presses Charges
  • Whether or Not Weapons Were Involved
  • Whether or Not the Victim's Privates Were Touched

Understanding the Degrees of Assault and Battery in South Carolina

Third Degree

Causing harm to someone or threatening to do so with the ability to carry out the threat can result in a charge of third-degree assault and battery. This misdemeanor offense is typically heard in municipal or magistrate courts and may carry a maximum sentence of 30 days in jail.

Second Degree

Causing harm or making threats to harm someone that results in moderate bodily injury can lead to charges of second-degree assault and battery. Additionally, touching someone's private parts without their consent can also result in charges of assault and battery in the second degree. This misdemeanor offense is heard in General Session court and can carry a maximum sentence of three years in prison.

First Degree

Assault and Battery in the first degree can involve a number of actions such as inflicting an unlawful injury when kidnapping, touching a person's privates "with lewd and lascivious intent," and much more. What began as a passion project is soon becoming a brick-and-mortar shop in Pawleys Island for husband-and-wife team Joe and Tatiana Parrilla.

The couple first launched Kind Ideas Home and Gift, a small business specializing in handcrafted wooden goods. While showcasing their pieces to potential customers, they began styling photo shoots with charcuterie boards arranged on the wooden surfaces, a creative touch soon inspiring something more, according to the website.

“We’d share them with friends and family after the photos were done, and the reactions were always the same: ‘Wait, you made this?’ That’s when Lowcountry Bites was born,” Tatiana shared via the website.

Lowcountry Bites, previously available only for pick-up and delivery, is opening at 115 Willbrook Blvd., where each festive board will tell a story through color, texture and flavor.

Alongside their signature charcuterie boards with artisan meats and cheeses, the new location will continue to showcase creative boards, grazing tables, and fruit and vegetable platters.

One standout option is the brunch board, featuring bagels, artisan cheese, smoked salmon, hard-boiled eggs, cream cheese, jam, honey and crackers. Guests can upgrade it with capers, red onions and lemon wedges.

Another favorite is the campfire board, which includes artisanal cheese, cured meats, seasonal fruit, graham crackers, marshmallows and Hershey’s chocolate. It can be upgraded with Nutella and Rice Krispies.

Once open, they plan to broaden their menu to include gourmet sandwiches and salads, complemented by their specialty coffee offerings.

“Lowcountry Bites is more than a small business—it’s a celebration of craft, connection, and community. I hope when people see our boards, they feel thought of. I hope they see the care behind each bite. And I hope they know they’re supporting someone who deeply loves what she does,” Tatiana said.

The website teases the opening with the message, “Coming soon, your new go-to spot for charcuterie + cafe delights,” though an official opening date hasn’t been announced. In the meantime, customers can still order for pick-up or delivery.

For updates, visit the shop’s website and follow along on Facebook and Instagram.

PAWLEYS ISLAND — When Erin Carachilo and George Eddis decided in May to buy Pawleys Tap House & Grill, they didn’t expect to also take over the smaller space next door.

But it gave them the opportunity to open The Crooked Cork — Pawleys Island’s only English pub.

The space was formerly occupied by Bourbon and Burnz, a cigar and bourbon bar. It’s now been transformed, with sports team banners hanging from the ceiling and a back room with four dartboards and Golden Tee, a golf arcade game.

It’s the kind of place where the couple first met in Philadelphia.

"This is how I met my husband," Carachilo said. "My husband worked in a sports bar."

The Crooked Cork is set to have a soft opening next Friday, and a grand opening will follow.

Carachilo described the pub as "casual, no-frills and fun," with simple and convenient food offerings. At first, the menu will include just five entrees: fish and chips, bangers and mash, shepherd’s pie, a pub burger with caramelized onions and whiskey aioli, and a pub salad with pickled beets, pickled asparagus and deviled eggs.

Appetizers will include Bavarian pretzels with beer cheese, Reuben egg rolls and potato nachos.

Carachilo said they had to trim the menu down to less than half of what Mike Cady, the pub’s chef, had originally proposed because the kitchen is small. But that’s alright with Carachilo — she’s of the mindset that less is more, especially if it’s done well.

Cady joined the Crooked Cork crew after working at Pawleys Tap House & Grill. He’s been a chef for 35 years and has worked in both the restaurant and hotel industries. He also opened a Cajun restaurant in Charlotte.

He said he’s confident the pub will be a hit with residents and visitors.

"Come summertime, it’s going to be busy. There’s no doubt, I mean in my mind, that this place is going to do well,” he said.

The Crooked Cork’s beer selection will range from a $2 brew to higher-end offerings such as Guinness. Customers can also order the Shabby Hammock, a pilsner brewed by Tidal Creek Brewhouse for Pawleys Tap House & Grill. Carachilo said 15 percent of Shabby Hammock sales go to a new local nonprofit each month.

In November, proceeds went to an organization that assists veterans. In December, sales will benefit the Waccamaw Neck library.

The building’s patio has been extended to allow for more outdoor seating, and TVs have been mounted so customers can watch sports from the deck.

Eddis and Carachilo are sports fanatics and plan to broadcast soccer, baseball, football and other games customers might request.

The pub will have special hours during soccer season. Because the games are often early for U.S. fans, Carachilo said it will open at 6 a.m. to serve beer and breakfast when soccer is on.

“When we lived in Florida, there was an English pub near our house and, like, (our) Saturday and Sunday ritual was to go to that at like 6:30 … in the morning for kegs and eggs, which is what we’re going to do here," she said.

When soccer isn’t in season, the pub will be open from 3-11 p.m. Monday through Wednesday. Thursday through Saturday, it will be open at least until midnight.

Eventually, the pub will host live music and dart tournaments, although it will be casual competition.

"You win pride," Carachilo said.

PAWLEYS ISLAND, S.C. (WCBD) — King tides and heavy rain are causing major flooding across Pawleys Island, leaving roads washed out and neighborhoods underwater.

Dozens of Lowcountry beaches and communities are feeling the effects of a powerful coastal system. Areas like Pawleys Island are seeing flooding firsthand, with many roads completely washed out due to heavy rain and king tides.

Pawleys Island experienced extremely high tides and rough surf early Friday morning, and officials are urging residents to stay weather-aware through the weekend.

Floodwaters have covered several roadways and beach access points on the barrier island. Three to four inches of standing water have spread through neighborhoods, forcing residents and visitors to move their cars to higher ground.

Some neighbors have even put up signs asking drivers to slow down to avoid sending waves of water into nearby yards. Leaders describe this as some of the worst flooding they’ve seen in years comparing it to the nor’easter that hit the area in 2022.

While tides are expected to recede by Saturday morning, officials are urging the public to stay home and keep both themselves and first responders safe.

“We have some very serious and dangerous conditions that are occurring very dangerous waves and currents. We encourage folks to stay out of the ocean until the conditions improve,” said Brandon Ellis, Director of Georgetown County Emergency Services. “It’s extremely dangerous not only for swimmers and surfers, but also for our first responders who have to rescue them.”

Georgetown County officials say emergency personnel and water safety response teams remain on standby as conditions continue to change.

PAWLEYS ISLAND — A new discount grocery store is set to open in the Pawleys Island area this month, and early shoppers will have a chance to take home some giveaways from the grand opening.

Aldi will celebrate the arrival of its first Georgetown County store on Oct. 30, according to the company’s website.

The German-owned chain is known for stocking products mostly under its own label, as well as fresh meats and produce. Shopping carts are accessed by depositing a refundable quarter, and customers are encouraged to bring their own shopping bags, as Aldi doesn’t provide them for free.

The new store is at 75 Petigru Drive. It’s adjacent to Pawleys Island Plaza, home to such retailers as Publix, Petco, T.J. Maxx and Rack Room Shoes.

The first 100 customers to enter the store on Oct. 30 will receive a "golden ticket" that could be worth up to $100, as well as a bag filled with free Aldi products, according to the store’s website. Shoppers can also scan signs posted throughout the store for a chance to win a $500 Aldi gift card. Employees will hand out free reusable shopping totes.

The store will be open for shopping on Oct. 29 to allow customers a sneak peek before the grand opening.

There are 54 Aldi stores in the state, including locations in Conway, Myrtle Beach, North Myrtle Beach and the Surfside Beach area.

On Feb. 7, the company announced a plan to open more than 225 stores across the country as part of its five-year national growth strategy.

Aldi acquired Southeastern Grocers, the parent company of Winn-Dixie and Harveys, last year in an effort to expand its presence in the Southeast. In total, ALDI will convert approximately 220 Southeastern Grocers locations to the ALDI format through 2027, according to its website.
